at 54 peralta avenue for construction of a driveway ramp. >> sponsor is david chiu and from dpw we have david qwan >> my name is eleanor tapk and i am with the department of public works. our office received a major encroachment request from sia consulting on october 26, 2011. the request is to remove and reconstruction a portion of the city-owned maintaining wall to construct a concrete driveway ramp with transition slope to conform to the existing sidewalk grade in order to provide vehicle access to the property at 54 peralta. we have reviewed project, the project has been routed to city planning for them to review on the conformity to the general plan and we receive a letter from them in december 12, 2011, stating that the project conforms to the general plan. we also referred the project to transportation advicery staff committee for them to review and they approved the project on march 22nd, 2012. the project subsequently referred to our department, structural section, hydraulic section, and to the disability sf (inaudible) for their review and they approved the project. we condu

dpw and cal train committed to incorporate landscaping to enhance both those projects. lastly, we have heard consistently from the community, the importance of incorporating a local job opportunities and contracting opportunities and so this funding request includes a request for developing an outreach strategy to go out and engage folks in the community so they can participate in the opportunities that will be available with both of these projects. given the work we've done and the community outreach, we are essentially, i think we kind of presented this conclusion or rather thinking on it initially but further work has essentially found that the option one, the berm option combined with the connector road really are not ideal are the best options we have in terms of maintaining that bridge with the funds we have in terms of facilitating a station and maintaining local access. and in terms of facilitating other land use activities in the area. those include the pc but go into a little more detail. we also included in this package of improvement and city project for the connector road

noticed but i'm just wondering how dpw generally follows up with residents with these concerns. i think there is some comments made that the department's hearing was in june and that the first they had learned of this kind of was a few days ago, but i'm just wondering what's your general process of following up with residents. >> thank you, commissioner. thank you, supervisor. normally what happens is usually within 30 days of a hearing, we would provide a finding or notification to all the people who attended that hearing. in this specific case, because there was additional review required, it delayed -- without that information we could not make a final decision and that delayed it. we were unable until approximately early to mid-november to generate the final finding in this case and i think it became a timing issue of getting it to the citizens and the people who were at that hearing and then as it relates also to supporting this to this board at this point, but we normally do try to inform the people at the hearing and the applicant within 30 days or once a decision has been made

with the dpw they say it's still up for discussion. and they won't really give us a clear answer. it's been really frustrating and affected our business dramatically from where we can operate. that is one thing. then other thing i wanted to touch upon. there is a big common misconception that many people in restaurant associations and in building management have been making about that food trucks are not healthy. that is a big misconception about what current food trucks are able to produce. we are an indian food truck, punjabi and half of our menu is vegetarian and vegan. very healthy for you. so i think they are just kind of slowing stones to knock us down. that has been a little upsetting. if you look at the true ethnicity of all healthy food that have come out of the food trucks from filipino, vietnamese and korean, it's a healthy option for people in san francisco that is really a food capital of this nation and it's really welcoming and something that people should be aware of. thank you very much. >> thank you very much. >> next speaker. >> good afternoon commissioners. my name i

to -- for those who tend to appeal, would appeal, because dpw is not -- dpw is not going to be issuing the notices. there is a 300' notice requirement and a 30-day, correct? yes. so that is already in place. so again, just what is maintaining is that should the permit be contested, again then again dpw can take into consideration the like food and 300 feet. those considerations are still being maintained. when we initially made the initial regulation, the consideration of the like food within 4 -- 300 feet. i think currently and andres, maybe you can come up to make sure this is clear. it's following the current formula retail requirements. my understanding is that formula retail mobile food vendors would not have to go through the conditional use process there. it's where the conditional use process requirements are set upon formula retail, which is in the n-c districts except for the places where formula retail is not allowed. >> it says before dpw even issued a permit there is a requirement that it be heard at the planning commission and in effect in the practical sense of wh

plan for that in a minute. other work we've done worked with dpw to develop an initial design concept for that connector road to show it's a feasible concept. we've done two rounds of extensive community outreach to share our work as well as interagency coordination with dpw, mta, cal train as well as other local agency partners. diving a little more into the community outreach we've done, we have worked through two prerobust rounds of outreach. first of those were back in spring. we did an open house and other presentation to present the work we had done in the first few months after we got that appropriation and get the community's feedback. we came back to the community in november to present our draft back recommendation how we incorporated a lot of that community feedback before coming here to the board. each of those rounds included an open house with pretty good solid participation as well as notification for that each round including multilingual efforts with efforts to everyone within a half a mile. additional fliers and businesses, neighborhoods, churches, community groups t

costs up front after two years of paying my permit and paying in excess of 2,000, dpw informed me the police department committed an error. it was in violation of the municipal police code. dpw senior managers waived the nee on a new location but couldn't approve a refund. the claim was dean nied. michelle wu, the hearing officer, dpw, gave me the option to finish out the year at dolores park or choose a new location. many of the prime locations have been occupied over the years, and the new regulation doesn't require you to pay a $10,000 fee. do you think the city has given me back the money? and to this day, i still don't have a comparable location. mistakes happen and that's why i wasn't seeking additional damages. i just wanted the money back that i paid. i realize each of you are extremely busy. i know you have to choose which issues to get involved in. remember which issues you also ignore speak volumes of your character. i can only hope these things from a leader that you feel this is important in maintaining high ethics, that you see the importance of taking action for sma

not sure what to say. we're here -- we got the appeal from the dpw and we were asked to do some things. we distributed keys and went with the hours of operations and applied for the property building permits that the department of building inspection and went through planning. so we have got gone through the dpw, dbi approved the plans. we haven't quite got it all signed off because we were told to stop on it somewhere along the line when the dbi permit got approved. we did the load studies for the people coming and going and access and push bars and the keys. so it's pretty easy to walk in and out of the door, it works and it can be accessible, if it needs to be. i'm not sure how you would get a wheelchair in the building once it's in there, but it's not a problem. we have to do something with the grade there, but we haven't finished a lot of this stuff and somebody was talking about the structure. we haven't completed it because we were told to stop on it. which they are all pretty simple things to complete, the structure. i think it's a good thing for the building. it keeps them c

between port and dpw and through the -- using two procedures, that's our mayor has been promoting for the last 12 months. one is broadening of construction projects and the second is prompt payment. so, when we started in early october, we gathered the entire project team. the contractor his subs, suppliers, the port staff, the consultants, dpw and we agreed on a plan to move forward. we agreed on the deadline and on a weekly basis, we met to hash out every single detail so we can meet this deadline. the contractor told us if you want to move fast, you need to pay us fast. instead of the 230 day city policy that we use on other projects, on this project we managed to pay the contractor within five days. so, and like i said, this is what you see, you know, today. i want to thank mayor ed lee for his vision and leadership and for his directive to make the partnering on construction projects and prompt payments and to make it much, much easier for small and large contractors to do business in the city. i want to thank monique and the port for their confidence in public works and for
